By accessing or using NajeeSmithCreative.com, you agree to be bound by these Terms & Conditions. If you do not agree, please discontinue use of the site.

Najee Smith Creative

By booking a session, purchasing images/videos, or accessing any gallery provided by Najee Smith Creative, you agree to the following Terms of Service.

1. Booking & Payment

A session date is not officially reserved until payment, deposit, or confirmation has been received.

Full payment may be required before final images or videos are delivered.

Prices, packages, and availability are subject to change at any time without notice.

2. Gallery Proofs & Watermarked Images

Preview galleries may contain watermarked or low-resolution proof images for selection and purchasing purposes.

Proof images are not permitted to be:

  • Screenshotted

  • Cropped

  • Edited

  • Downloaded without permission

  • Reposted publicly

Purchased final images will be delivered in high-resolution without watermarks unless otherwise stated.

3. Copyright & Usage

All photographs and video content created by Najee Smith Creative remain the intellectual property and copyright of Najee Smith Creative.

Clients receive personal-use rights unless otherwise agreed upon in writing.

Images/videos may not be:

  • Resold

  • Altered with filters or heavy edits

  • Submitted to brands/businesses for commercial use

  • Used for advertising or promotional campaigns without written permission

Commercial licensing is available separately.

4. Social Media Sharing

Clients are welcome to share purchased content on social media.

Credit is appreciated when posting:

Removing watermarks or claiming the work as your own is prohibited.

5. Turnaround Time

Editing and delivery timelines vary depending on the type of session, event coverage, and workload.

Estimated turnaround times may be discussed before or after the session.

6. Creative Style

By booking with Najee Smith Creative, clients acknowledge and agree to the creative editing style, composition, and artistic direction represented in previous work and portfolio examples.

RAW/unedited files are not included unless specifically agreed upon.

7. Cancellations & Rescheduling

Sessions may be rescheduled due to:

  • Weather

  • Emergencies

  • Unsafe shooting conditions

  • Scheduling conflicts

Deposits may be non-refundable depending on the circumstances and timing of cancellation.

8. Liability

Najee Smith Creative is not responsible for:

  • Missed moments caused by venue restrictions, weather, lighting limitations, or circumstances outside of control

  • Injuries during sessions or events

  • Third-party platform outages or gallery hosting interruptions

9. Delivery & File Storage

Final galleries and downloads should be saved by the client upon delivery.

Long-term file storage is not guaranteed, though reasonable efforts may be made to retain backups.

10. Agreement

By booking services, accessing galleries, or purchasing content from Najee Smith Creative, you acknowledge that you have read, understood, and agreed to these Terms of Service.
